{"id":12673,"date":"2023-07-07T11:11:42","date_gmt":"2023-07-07T14:11:42","guid":{"rendered":"https:\/\/www.fie.undef.edu.ar\/ceptm\/?p=12673"},"modified":"2023-07-07T11:11:42","modified_gmt":"2023-07-07T14:11:42","slug":"francia-ley-de-seguimiento-de-sospechosos-mediante-dispositivos-conectados-a-la-web","status":"publish","type":"post","link":"https:\/\/www.fie.undef.edu.ar\/ceptm\/?p=12673","title":{"rendered":"Francia, ley de seguimiento de sospechosos mediante dispositivos conectados a la web\u00a0"},"content":{"rendered":"<p>Como parte de un proyecto de ley de reforma de la justicia m\u00e1s amplio, los legisladores franceses otorgaron a la polic\u00eda francesa la autoridad legal para espiar a los sospechosos mediante la activaci\u00f3n remota de c\u00e1maras, micr\u00f3fonos y la funcionalidad de ubicaci\u00f3n GPS en el tel\u00e9fono inteligente de una persona y otros dispositivos conectados.\u00a0La nueva ley cubre computadoras port\u00e1tiles, veh\u00edculos, tel\u00e9fonos inteligentes y otros dispositivos conectados y solo se utilizar\u00e1 cuando una persona sea sospechosa de un delito punible con al menos diez a\u00f1os de prisi\u00f3n.<\/p>\n<hr \/>\n<p>As part of a broader justice reform bill, French lawmakers have given French police the legal authority to spy on suspects by remotely activating cameras, microphones, and GPS location functionality on a person\u2019s smartphone and other connected devices.<\/p>\n<p>The new law covers laptops, vehicles, smartphones, and other connected devices and will only be used when an individual is suspected of a crime that is punishable by at least ten years of prison time.<\/p>\n<p><a href=\"https:\/\/www.ndtv.com\/world-news\/france-set-to-allow-police-to-spy-through-phones-4182299\" target=\"_blank\" rel=\"follow external noopener\" data-wpel-link=\"external\">As\u00a0<em>NDTV<\/em>\u00a0reports<\/a>, despite cries of authoritarianism and unjustifiable government oversight from people on both sides of the political spectrum, French Justice Minister Eric Dupond-Moretti claims that the new regulations will affect only \u201cdozens of cases a year.\u201d<\/p>\n<p>Devices could remotely be used to record sound and images of people suspected of serious crimes, including terrorism and organized crime.<\/p>\n<p>A French anti-censorship and surveillance group,\u00a0<a href=\"https:\/\/www.laquadrature.net\/en\/\" target=\"_blank\" rel=\"follow external noopener\" data-wpel-link=\"external\">La Quadrature du Net<\/a>\u00a0(LQDN), argued earlier this year that the newly-passed legislation raises significant concerns about the infringement of \u201cfundamental liberties.\u201d LQDN says that people have a right to privacy that is violated by the \u201cheavy-handed\u201d proposal.<\/p>\n<p>Lawmakers in French President Emmanuel Macron\u2019s corner argued for an amendment that limits the new remote spying privileges to situations \u201cwhen justified by the nature and seriousness of the crime\u201d and only \u201cfor a strictly proportional duration.\u201d<\/p>\n<p>For authorities to utilize remote spying surveillance measures, a judge must approve the usage. The period of surveillance can be up to six months.
